Terms of Service

1. Acceptance of Terms

By purchasing, downloading, or using VibeSafely, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use VibeSafely. These terms apply to all users, purchasers, and visitors.

VibeSafely is operated by VibeSafely. These terms constitute a legally binding agreement between you and us.

2. Product Description and License

VibeSafely is a Next.js 15 SaaS boilerplate that includes:

• Complete Next.js 15 application with security-first architecture
• Stripe payments integration and secure checkout system
• OpenAI GPT integration with safety filters and cost controls
• AES-256-GCM zero-knowledge encryption system
• PostgreSQL and Redis database configurations
• GDPR compliance tools and data protection features
• Automated deployment scripts for Vercel
• Comprehensive documentation optimized for AI development

License Grant: Upon payment, you receive a perpetual, non-exclusive, non-transferable license to use VibeSafely for unlimited personal and commercial projects. You may modify the code for your own use.

3. Purchase Terms and Pricing

One-Time Payment: VibeSafely is sold as a one-time purchase for €99 (currently discounted from €149 during launch offer). This includes:

• Lifetime access to the VibeSafely codebase
• All future updates and feature additions
• Access to private GitHub repository
• Email support and community access
• Complete documentation and deployment guides

Payment Processing: All payments are processed securely through Stripe. We do not store payment information. Payments are final and non-refundable except as required by law.

4. GitHub Access and Security

After successful payment, you will provide a GitHub username to receive collaborator access to the private VibeSafely repository.

• Each purchase grants access to exactly one GitHub account
• Access cannot be transferred to different GitHub accounts
• You are responsible for maintaining the security of your GitHub account
• Sharing access with others violates these terms and may result in access revocation
• We validate all transactions with Stripe before granting access

5. Acceptable Use and Restrictions

You may:

• Use VibeSafely for unlimited personal and commercial projects
• Modify and customize the code for your own use
• Deploy applications built with VibeSafely commercially

You may NOT:

• Resell, redistribute, or sublicense VibeSafely as a boilerplate or template
• Share your GitHub repository access with others
• Create competing boilerplate or template products using VibeSafely code
• Reverse engineer or attempt to extract the underlying architecture for redistribution
• Use VibeSafely for illegal activities or to violate others' rights
• Remove or modify copyright notices and attributions

6. Intellectual Property Rights

VibeSafely IP: We retain all intellectual property rights in the VibeSafely name, brand, original architecture, and unique implementations. The license granted does not include rights to our trademarks or brand.

Your Applications: You retain full ownership of applications you build using VibeSafely, including any modifications or additions you make to the codebase.

Third-Party Components: VibeSafely includes open-source components with their own licenses. You must comply with all applicable third-party licenses.

7. Privacy and Data Protection

Our Privacy Policy, incorporated by reference, governs data collection and processing. Key points:

• We collect minimal data necessary for transaction processing and support
• All sensitive data is encrypted using zero-knowledge encryption
• We comply with GDPR and other applicable privacy laws
• You have rights to access, correct, and delete your personal data

8. Support and Updates

Support: We provide email support for technical issues and questions about VibeSafely. Support is provided on a best-effort basis with no guaranteed response times.

Updates: You receive all future updates to VibeSafely at no additional cost. Updates may include:

• Security patches and vulnerability fixes
• New features and integrations
• Framework updates (Next.js, React, etc.)
• Documentation improvements

We reserve the right to discontinue support or updates at any time with 30 days notice.

9. Service Availability

We strive to maintain high availability but cannot guarantee uninterrupted service. We reserve the right to:

• Temporarily suspend service for maintenance or updates
• Modify or discontinue features with reasonable notice
• Restrict access for security or legal compliance reasons

10. Disclaimer of Warranties

VibeSafely is provided "AS IS" without warranties of any kind. We disclaim all warranties, express or implied, including:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Security against all possible vulnerabilities
• Compatibility with all systems or use cases

You use VibeSafely at your own risk. We recommend thorough testing before production deployment.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

Our total liability for all claims related to VibeSafely shall not exceed the amount you paid for the license (€99).

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless VibeSafely from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of VibeSafely in violation of these terms
• Your applications or modifications to VibeSafely
• Infringement of third-party rights by your use
• Any illegal or unauthorized activities

13. Account Termination

We may terminate or suspend your access to VibeSafely if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Share or redistribute VibeSafely inappropriately
• Use VibeSafely for illegal activities

Upon termination, your license to use VibeSafely ends, but you may continue using applications already built.

14. Governing Law and Dispute Resolution

These terms are governed by the laws of Norway, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration or in Norwegian courts.

EU consumers retain their right to bring proceedings in their country of residence and may benefit from mandatory consumer protection laws.

15. Changes to Terms

We may update these Terms of Service to reflect changes in our practices, legal requirements, or business operations. Material changes will be communicated via email or prominent notice at least 30 days before taking effect.

Continued use of VibeSafely after changes indicates acceptance. If you disagree with changes, you may stop using VibeSafely but retain rights to previously licensed versions.

16. Severability and Entire Agreement

If any provision of these terms is found invalid or unenforceable, the remaining provisions continue in full force. These Terms of Service and our Privacy Policy constitute the entire agreement between us.
